An appeal hearing challenging the city of Hood River’s decision to award a permit for the Nichols Landing hotel and retail development has been pushed back to later this month at the request of the project applicants.
Naito Development LLC, the project’s applicant, made a formal request through their attorney, Steve Naito (as well as brother of Bob Naito, head of the development firm), who asked the city for more time “to respond to certain matters raised by opponents.”
The Hood River City Council honored the request at its regular meeting Monday night, pushing back the appeal hearing from Aug. 11 to the next council meeting, which is scheduled for Aug. 25.
Friends of the Hood River Waterfront, a local citizen group, appealed a decision made by the Hood River Planning Commission last month to issue a conditional use permit for the development, which would consist of an 88-room hotel and a 20,000-square-foot commercial building located at the south end of the Nichols Boat Basin. The development has been the subject of multiple legal challenges over the past several years
Friends has filed two appeals relating to the Nichols Landing development. The first appeal challenges the planning commission’s response to a remand late last year from the Oregon Land Use Board of Appeals regarding the project. The second challenges the city’s issuance of a floodplain development permit for the project. In the appeal, Brent Foster, attorney for Friends, claims the city made several errors with both the response to the remand as well as the floodplain development permit.
In light of the request to the city, Naito said the time period to finalize a decision on issues pertaining to the remand would be extended until Thursday, Sept. 25. The next hearing on Naito is scheduled to take place in city council chambers on Monday, Aug. 25 at 6 p.m.
