Bourbon, rye and whiskey sit next to each other on every back bar in America, and most people who order them can’t explain how they’re related. The confusion is so widespread that cocktail menus routinely list bourbon alongside whiskey as though they belong in different families. The actual relationship between these bottles is simpler than their labels suggest, defined by a few lines of federal regulation and a single grain.
Congress gave bourbon a distinction few American spirits share. A joint congressional resolution in 1964 declared bourbon whiskey “a distinctive product of the United States,” placing it alongside Scotch and Cognac as a geographically protected spirit. More than four decades later, a 2007 Senate resolution designated September 2007 as National Bourbon Heritage Month and called bourbon “America’s Native Spirit.” The 2007 resolution attributed that phrase to the 1964 declaration, although the 1964 text itself used the wording “distinctive product of the United States.”
The industry has observed it every September since, and both resolutions point back to the same underlying framework that governs bourbon today: Title 27 of the Code of Federal Regulations, where the Alcohol and Tobacco Tax and Trade Bureau currently defines exactly what each spirit must be.
What the law actually says
The federal standard of identity for whiskey covers a broad category: any spirit distilled from fermented grain mash at less than 190 proof, generally stored in oak barrels and bottled at 80 proof or above. Corn whiskey is the notable exception, and is exempt from the oak-storage requirement entirely. Bourbon and rye are both types of whiskey under that definition, governed by the same section of the regulation and subject to nearly identical production rules.
Bourbon must come from a fermented mash of at least 51% corn, be distilled at no more than 160 proof and be entered into new charred oak barrels at no more than 125 proof. Rye whiskey follows the same distillation ceiling, barrel-entry proof and new charred oak requirement, but swaps the grain floor to 51% rye.
Both are classified as distinctive products of the United States under the same regulation, meaning neither can carry that label if produced outside the country. The grain bill is the primary legal distinction, though bourbon carries one additional restriction: it cannot include added coloring, flavoring or blending materials that other whiskeys in its class, including rye, are permitted to use.
One persistent source of confusion involves Canadian whisky, which is often called “rye” even when its grain bill is mostly corn or wheat. Canadian rye is governed by Canadian law and follows a different set of rules, so an American bottle labeled “rye whiskey” must meet the 51% rye requirement, while Canadian whisky labeled as rye is not subject to the same minimum.
“Broadly, whiskey is any spirit distilled from grain. It’s essentially distilled beer, in the same way that brandy is distilled wine. Within that category you find a lot of different styles that arise from region, grain selection, climate, and culture,” says Ari Sussman, whiskey maker for Whiskey JYPSI, the brand co-founded by Eric Church and Raj Alva. “Bourbon is the most popular American style of whiskey. It has to be at least 51% corn, aged in a new oak barrel and produced in the US. Similarly, Rye whiskey has a minimum of 51% rye grain and the new oak requirement. That’s really the extent of the rules,” he added.
The grain changes the glass
The 51% corn floor gives bourbon its generally softer, sweeter profile. Much of what drinkers associate with bourbon, the vanilla, caramel and toasted notes, comes from the interaction between the spirit and charred new oak during aging, as compounds in the wood break down and infuse the whiskey over time. A bourbon with a high-corn mash bill, and some run 70% or above, leans even sweeter and sometimes picks up a roasted nuttiness.
Rye-heavy whiskey is often associated with pepper, baking spice and a drier, more assertive profile. The barrel treatment is identical for both spirits, so the wood contributes similar char and caramel-like notes to each. With production and maturation held constant, the grain becomes the primary variable separating the two.
Mash bills vary widely above that 51% legal floor, and those variations matter more than most drinkers realize. Many bourbons carry a meaningful percentage of rye in their remaining grain mix, which nudges the flavor toward spice, while some rye whiskeys include enough corn to soften the edges. A high-rye bourbon and a rye whiskey with a generous corn complement can taste more alike than their labels suggest.
The grain split also explains why rye and bourbon have historically ended up in different cocktails. A Manhattan calls for rye by tradition because the drier spice cuts through sweet vermouth without letting the drink tip toward cloying. A Sazerac pairs rye’s peppery bite with the anise notes in Peychaud’s bitters.
Bourbon is the classic backbone of an Old Fashioned, where corn sweetness works alongside sugar and bitters to build a rounder, warmer drink. It’s also the expected pour in a Mint Julep, where that sweetness and fresh mint are natural partners. Bartenders today swap freely between the two, and knowing the grain gives a useful starting point for understanding why a familiar cocktail tastes the way it does.
“Corn leads to a smoother, rounder spirits. Rye grain contributes spice, dryness and depth. Everything after that is open. A distiller can work with hundreds of varieties of corn, rye, barley, wheat, or any other they can get their hands on. Where the whiskey matures also influences the spirit. In Texas, a barrel imparts its character quickly, while in the north the process is slower and more controlled. Whiskey is the genus; bourbon and rye are species, and there’s enormous variety inside each of them,” Sussman said.
That same flavor logic extends past the glass and into the kitchen. Christa Singletary, assistant director of pastry and cafes for the Indigo Road Hospitality Group at Barn8, reaches for bourbon in her salted caramel sauce. “One of my favorite ways to use bourbon as a pastry chef is in my salted caramel sauce,” Singletary said. “I find that it helps give a more complex flavor profile and can easily incorporate a smokiness without overpowering the sweetness. It’s a great way to complement dark chocolate desserts.”
The newest entry on the federal books
Federal regulators are still actively expanding the American whiskey category. In December 2024, the TTB finalized a standard of identity for American single malt whiskey, with the new rule taking effect in January 2025. The standard requires 100% malted barley, distillation at a single U.S. distillery and storage in oak barrels. It was the first new whiskey type added to the federal regulations in more than 52 years.
Bourbon Heritage Month this year coincides with the 35th anniversary of the Kentucky Bourbon Festival in Bardstown, running Sept. 10 through 13 with more than 70 distilleries and 200 brands pouring on-site. Kentucky accounts for roughly 95% of all bourbon produced worldwide and holds 16.1 million aging barrels of bourbon, part of 17.1 million total spirits barrels statewide. The Kentucky Bourbon Trail draws almost 3 million visits a year.
The Frazier History Museum in Louisville serves as the official starting point of the Kentucky Bourbon Trail and runs a Craft Your Own Cocktail Experience where guests learn to build an old fashioned from scratch. The city’s Urban Bourbon Trail picks up where distillery tours leave off, threading a collection of bars and restaurants with some of the country’s largest bourbon selections. For a more hands-on stop, Pursuit Spirits opened on Main Street in 2025 and puts visitors behind the barrel, with tastings, private picks and bottling straight from the source.
The American whiskey category is broader now than it was two years ago, and the legal framework that governs it is expanding to match what distillers have already been producing. Getting from the 51% rule to a preferred pour still takes a few cocktails, at least one tasting flight and probably a spirited debate about whether a Manhattan works better with rye or bourbon. September offers 30 days to work on all three.
