(The Center Square) – A $359.1 million Colorado preschool program, paid for mostly by tobacco and nicotine taxes, reached the U.S. Supreme Court on Tuesday over a single condition: providers must agree not to turn families away.

Colorado appropriated $359.1 million for universal preschool in fiscal year 2025-26, according to Joint Budget Committee records, most of it from a cash fund fed by taxes voters approved in 2020.
