For years, local newspapers have battled the consequences of big technology companies controlling how their reporting reaches readers and how advertising dollars flow.
As first discovered by Nieman Lab through its investigative reporting on Oct. 15, 2026, Meta announced that it was revising its commercial terms with provisions that appear to give it broad rights to access, scrape, collect and use content from publishers’ websites in connection with Meta’s products, without the publisher’s specific permission or compensation.
The big technology companies set their own rules for reaching audiences through their services — and change those rules to suit their own businesses, often to the detriment of the organizations that are providing the content.
Meta’s proposed commercial terms raise a challenge as AI changes how people receive news. Publishers are being asked to accept broad permissions to collect material from their websites as a condition of continuing to use Meta’s business products. Legal experts warn those permissions could extend to using publishers’ reporting in AI products. Nieman Lab brought the implications into sharper focus by examining the terms and asking legal experts what they could mean for publishers that agreed to them. That is worth remembering: journalists did the work of explaining a consequential change that might otherwise have received little attention.
At the core is a straightforward question: Why should a newspaper have to grant Meta access to its journalism simply because the newspaper wants to maintain a business presence on Facebook or Instagram? A social media presence does not, by itself, pay for the reporting. A local newspaper walking away from Meta products likely means reducing contact with its readers. Accepting overly broad terms could mean allowing the platform to use the newspaper’s work in competing products without negotiated compensation.
If Facebook and Instagram are important distribution channels for reaching local audiences, requiring publishers to surrender broad rights to their journalism as the price of maintaining that presence isn’t a genuinely voluntary commercial negotiation. That is not a meaningful choice.
AI makes the potential consequences greater. A platform can draw on a newspaper’s reporting to answer questions without sending readers to the newspaper itself. The platform gains a useful product. The newspaper loses an opportunity to earn revenue from the work it paid to produce.
Readers may still receive information. But over time, there may be fewer resources behind the original reporting that produced it. That is the risk to your community. Fewer resources for reporting mean fewer public decisions examined, fewer records checked and fewer officials questioned.
We believe that the impact of these changes will fall disproportionately on local and independent news publishers. These are the publishers who are doing the essential work of covering city councils, school boards, local businesses, courts, high school sports, community events and issues that often receive little or no attention from larger media organizations. They are also the publishers least able to absorb the loss of economic value that could result if their journalism is routinely collected and incorporated into products developed by one of the world’s largest technology companies.
Following objections, Meta revised the language and delayed implementation. Andy Stone, Meta’s VP of communications tweeted: “We’re committed to getting this right, and as we expect this consultation could extend beyond Nov. 20, in which case we’d delay implementation of the updated terms. Until then our existing terms remain in place.” Meta also promised consultation with industry leaders before proceeding.
We applaud Meta’s decision to delay implementation of the new rules, and we certainly encourage Meta to reconsider these provisions and engage with America’s Newspapers and publishers of all sizes, before the new terms take effect. Publishers should be able to choose how their journalism is used, and if a technology company wants rights beyond distribution, those rights should be negotiated — not extracted as a condition of access to an audience. Access to a platform’s audience should not become the price publishers pay to let that platform compete with them using their own work.
