PORTLAND — The Columbia River Compact Monday shut down Indian subsistence fishing on the Columbia River and the Indians have appealed to federal court 15 cases of Indians convicted of poaching.
The two actions came from separate directions. The river compact moved to halt fishing from main river platforms at Noon Wednesday. It based its action on low spring chinook salmon runs.
But the two-state compact decided to allow continued Indian ceremonial fishing in the Columbia River until permits for those fisheries expire late next week.
Staff biologists from the Oregon Department of Fish and Wildlife and the Washington Department of Fisheries recommended closure of both fisheries ... preferred catch of about 2,000 will be exceeded.
The appeal was filed last Thursday in the 9th U.S. Circuit Court of Appeals ... “That should overturn all of the federal convictions,” Schartz said, noting cases are pending in both Oregon and Washington state courts.
“The federal government did not have jurisdiction to try Indians for violating tribal law. The second part is that the government also did not have jurisdiction in federal court to try Indians for violating state law, because the state law violated federal treaties. ...”
