The liquor license of the Dufur Roadhouse was suspended for 68 days as of Monday, June 25, after the owner declined to pay a $5,940 civil penalty that would have shortened the suspension. The suspension will be lifted Sept. 1.
The business can stay open during that time, but it cannot serve alcohol on premise, according to the Oregon Liquor Control Commission, which imposed the suspension.
The suspension does not prohibit sales of liquor to go.
The Roadhouse did not contest the penalty and fine. It was given a mandatory suspension of 32 days, but had the option of paying the civil penalty in lieu of a full 68-day suspension.
When the penalty wasn’t received by OLCC by June 20, the full suspension went into effect June 25.
The OLCC posted the license suspension notice on the doors of the Roadhouse. The notice is required to stay in place until the suspension is over.
The civil penalty was a large one, an OLCC spokeswoman said earlier. Typical fines are in the $1,000 to $2,000 range.
The OLCC found the Roadhouse committed four violations, all on Dec. 1: That owner/licensee Richard Hunt was on duty while under the influence of intoxicants; that the licensees permitted Hunt to serve alcohol to himself for on-premises consumption; that he was permitted to mix, sell or serve alcohol or supervise those who do, without a valid service permit; and that he permitted disorderly activity on or next to the premises when he harassed and threatened two women.
Hunt was arrested Dec. 1 by Wasco County Sheriff’s deputies on a charge of disorderly conduct.
The OLCC said it was a mitigating factor that the second through fourth violations are charged at the first level because they were discovered concurrently.
An aggravating factor the OLCC considered in setting the penalty was that Hunt was personally involved in every violation.
Wasco County Sheriff Lane Magill said, “I'm glad that action has been taken on the establishment by OLCC.
“The sheriff's office will continue to monitor the situation but we are confident the actions by the OLCC will have a direct effect on public safety in the Dufur community,” he added.
